Terms of Service

1. Parties to the Agreement

"Platform" refers to the Hartanah Bumiputera website (trading name) and all related services, owned and operated by Harta Pribumi Heritage(CA0426810-X). "User" refers to any individual or entity that accesses or uses the Platform, including:

• Standard User — Property buyers and tenants who register an account.
• Real Estate Agent — Individuals licensed under Act 242 who list properties.
• Developer — Housing development companies licensed under Act 118.
• Visitor — Individuals who access the Platform without registering an account.

2. Account Registration

2.1 Eligibility

• Users must be at least 18 years old and have the legal capacity to enter into contracts under the Contracts Act 1950.
• Registering using a false identity is prohibited and may constitute an offence under the Penal Code (Sections 415–420).
• Each individual is only permitted one active account at any given time.

2.2 Account Responsibility

• Users are fully responsible for all activity that occurs under their account.
• Users must notify the Platform immediately of any unauthorised use of their account.
• The Platform is not liable for losses arising from a User's failure to safeguard their password.

2.3 Agent Verification

• Real Estate Agents are required to provide a valid REN number during registration.
• The Platform reserves the right to verify the REN number with BOVAEA and terminate the account if verification fails.
• Agents who provide a false REN number are subject to legal action under Act 242 and the Penal Code.

3. Platform Services

3.1 Property Listings

The Platform provides property advertising space for informational purposes only. The Platform is not a broker, agent, or party to any property transaction. All dealings between sellers/landlords and buyers/tenants are the sole responsibility of the parties involved.

3.2 Agent Subscription Plans

All new agents are eligible for 30 days of free Premium access. After the free trial ends, the account will automatically be downgraded to Standard if no subscription is made.

3.3 Calculators and Estimates

All estimates provided by the Platform (mortgage calculator, stamp duty, legal fees, rental deposit) are for informational purposes only and do not constitute legal, financial, or tax advice. Users are advised to seek professional advice before making any financial decision.

3.4 Co-Broking Services

The Platform provides a Co-Broking feature allowing Premium Agents to mark an exclusive listing as available to share ("Co-Broking Available"), and other Premium Agents to request to become a co-broke agent on that listing, including proposing/agreeing a commission split between the Listing Agent and the co-broke agent.

• The Platform is not a party to any Co-Broking agreement. Any agreement on commission split, cooperation terms, or other terms agreed between the Listing Agent and the co-broke agent is a private contract solely between those two agents. The Platform does not become a party, guarantor, or agent for either party to that agreement.
• The PDF summary automatically generated by the Platform upon approval of a Co-Broking request is an informational record only, provided to help both parties keep a reference, and is not a contract document prepared, reviewed, or legally validated by the Platform. The Platform makes no warranty that this summary satisfies any contractual requirement under the Contracts Act 1950 or BOVAEA/Act 242 guidelines.
• The Platform is not responsible for enforcing, interpreting, or resolving any dispute arising from a Co-Broking arrangement, including (without limitation) disputes over commission division, a co-broke agent's work performance, or either party's failure to meet agreed terms.
• Agents are solely responsible for ensuring any Co-Broking arrangement complies with the Valuers, Appraisers, Estate Agents and Property Managers Act 1981 (Act 242) and relevant BOVAEA guidelines on co-agency (co-broking) arrangements and commission sharing.
• A listing cloned under a co-broke agent's account is a copy of the master listing for marketing and enquiry-routing purposes only; it does not create any ownership or interest for the co-broke agent in the underlying property or the original listing.

4. User Content

4.1 Content Licence

By uploading any content (photos, descriptions, documents) to the Platform, Users grant the Platform a non-exclusive, royalty-free, transferable, and sublicensable licence to use, display, and distribute such content for the purpose of operating the Platform.

4.2 Content Warranties

Users represent and warrant that:

• All content uploaded is accurate, true, and up to date.
• The content does not infringe the copyright, trademark, or personal rights of any third party.
• Property photos are genuine photos of the listed property and not stock photos or photos of other properties.
• The content does not contain fraud, prostitution, or unlawful activity.

4.3 Content Removal

The Platform reserves the right to remove or modify any content at any time without notice if such content violates these Terms, the Acceptable Use Policy, or any applicable Malaysian law.

5. Disclaimers and Limitation of Liability

5.1 General Disclaimer

The Platform is provided on an "as is" and "as available" basis without any warranty, whether express or implied. The Platform makes no guarantee that:

• Property listing information is accurate, complete, or current.
• The Platform will operate uninterrupted or error-free at all times.
• Any listed property remains available at the time an enquiry is made.

5.2 Limitation of Liability

To the extent permitted by Malaysian law, the Platform shall not be liable for:

• Direct, indirect, or consequential losses arising from use of the Platform.
• Fraud, misrepresentation, or breach of contract by any other User.
• Losses arising from property investment decisions made based on information on the Platform.
• Service disruption caused by factors beyond the Platform's control (force majeure).

The Platform's maximum liability to any User under any circumstances is limited to the amount paid by that User to the Platform within the 12 months preceding the claim.

6. Intellectual Property

All copyright, trademarks, designs, logos, and other intellectual property relating to the Platform are the exclusive property of Hartanah Bumiputera or its licensors. Users may not:

• Copy, modify, or create derivative works from the Platform without written permission.
• Use the Platform's trademarks or logos without written permission.
• Resell or commercially exploit any part of the Platform.

7. Data Extraction & Automated Use Prohibition (Anti-Scraping)

All property listings, photographs, descriptions, data and other content on the Platform are protected and may not be extracted, copied or republished without written permission. Without the prior written consent of Hartanah Bumiputera, Users and any third party are PROHIBITED from:

• Using any robot, spider, crawler, scraper, automated script or other means to access, collect, index, copy or bulk-download listings, photographs or data from the Platform;
• Copying, extracting, harvesting, or building a database from the Platform's content, whether manually or by automated means;
• Republishing, reposting, selling, distributing or transferring property listings, photographs or Platform content to any other platform, website or service;
• Framing, mirroring, or displaying the Platform's content on any other site without permission;
• Circumventing, disabling or interfering with any security measure, rate limit, robots.txt, or access control of the Platform.

Permitted automated access is only via an official API or a written syndication agreement with Hartanah Bumiputera. The Platform reserves the right to block IP addresses, suspend accounts, and pursue legal action (including under the Computer Crimes Act 1997 and copyright law) for any breach. Reciprocally, Users also agree not to post listings or photographs scraped or copied from other property portals without lawful rights — such accounts will be suspended.

7.1 Good-Faith AI Crawler Exception

Notwithstanding the general prohibition above, the Platform permits automated access by good-faith AI crawlers and agents (for example, for search indexing, AI model training, and answering user questions based on the Platform's content), subject to the following conditions:

• The crawler complies with the Platform's robots.txt directives, including the Content Signals (Content-Signal) declared therein, which set specific permissions for search, AI training (ai-train), and AI input (ai-input);
• The crawler identifies itself clearly via a valid User-Agent string and does not impersonate a human browser;
• Access occurs at a reasonable rate and does not burden the Platform's performance for other users (does not exceed applicable rate limits);
• Content is not bulk-republished as a duplicate or competing property portal — permitted use is for indexing, model training, or generating content-based answers, not republishing property listings as a standalone service.

This exception may be amended or withdrawn by the Platform at any time by updating robots.txt and/or these Terms. It grants no exclusive right or commercial licence — it is solely a conditional permission subject to ongoing compliance with the conditions above.

7.2 Agent & Owner Contact Details

Agents' and property owners' phone numbers, WhatsApp numbers and email addresses are protected. They are not displayed openly on pages or in the Platform's data; they are revealed one listing at a time when a user presses a contact button, subject to a daily limit per visitor/account. An agent's email address is never displayed — users contact agents through the Platform's contact form.

Users must not collect, record, copy, sell or distribute agents' or owners' phone, WhatsApp or email details by any means (including scripts, headless browsers, multiple accounts or IP addresses), use them for marketing or unsolicited messages without the owner's consent, or bypass the Platform's access limits and human verification. The Platform monitors access patterns and may, without notice, block access, suspend accounts, require deletion of collected data, and take legal action under applicable law, including the Personal Data Protection Act 2010 and the Computer Crimes Act 1997.

8. Third-Party Links

The Platform may contain links to third-party websites (Google Maps, PayPal, government portals). The Platform is not responsible for the content, privacy policies, or practices of such websites. Access to third-party websites is at the User's own risk.

9. Termination of Service

The Platform reserves the right to terminate or suspend a User's access at any time, with or without cause, including but not limited to:

• Violation of the Terms of Service or Acceptable Use Policy.
• Suspected fraudulent activity or misconduct.
• Requests from law enforcement authorities.
• Discontinuation of the Platform's operations.

10. Dispute Resolution

Any dispute arising from or relating to these Terms shall be resolved as follows:

1. Negotiation: The parties shall first attempt to resolve the dispute through negotiation within 30 days.
2. Mediation: If unsuccessful, the dispute shall be referred to the Malaysian Mediation Centre (MMC).
3. Arbitration: If mediation fails, the dispute shall be resolved by arbitration under the Arbitration Act 2005 in Kuala Lumpur.
4. Courts: Any legal proceedings are subject to the exclusive jurisdiction of the Malaysian courts in Kuala Lumpur.

11. Governing Law

These Terms of Service are governed, construed, and enforced in accordance with the laws of Malaysia. The principal applicable laws include:

• Contracts Act 1950
• Communications and Multimedia Act 1998
• Personal Data Protection Act 2010
• Computer Crimes Act 1997
• Valuers, Appraisers, Estate Agents and Property Managers Act 1981
• Housing Development (Control and Licensing) Act 1966
• National Land Code 1965

12. Amendments to Terms

The Platform reserves the right to amend these Terms at any time. Users will be notified by email or notice on the Platform at least 14 days before a material amendment takes effect. Continued use of the Platform after the effective date of an amendment constitutes acceptance of the amended Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the extent necessary to make it valid, and the remaining provisions of these Terms shall remain in full force and effect.
