What Is Malay Reserved Land?
Malay Reserved Land is a land status under the Malay Reservations Enactment 1913/1933 that can only be held by ethnic Malays — specifically defined as a person who professes the Islamic religion, speaks the Malay language, and practises Malay customs. This definition is narrower than "Bumiputera" in general, and its restrictions are tied to the land title itself — not merely the first sale condition. This means leasing the land/buildings on it to non-Malays, or operating non-Malay owned businesses on it, are also subject to restrictions.
Can Malay Reserve Status Be Revoked?
In theory an owner may apply to the State Authority, but it requires official gazetting by the respective Menteri Besar/Chief Minister under Article 89 of the Federal Constitution, plus the requirement of replacement land with equivalent characteristics and area gazetted simultaneously. This process rarely occurs and is far stricter than the Bumiputera Lot release process — it is not a routine option for individual owners wishing to sell to non-Malays.
Do not confuse with Bumiputera Lot — a separate status with a broader eligibility definition (all Bumiputera, not Malays only) and an easier release process through State Authority approval only (without the requirement for replacement land gazettement).
